Terms of Use

These Terms of Use ("Terms") apply to your use of the PickIt mobile app ("PickIt", "the app"), published by Hangar Apps ("we", "us"). By downloading or using PickIt you agree to these Terms. If you do not agree, please do not use the app.

1. The app

PickIt is a party and decision-making app with tools such as a finger picker, spinning wheel, coin flipper, dice roller, team generator and a truth or dare game. Results are random and provided for fun only. Please do not rely on PickIt for important decisions, bets, or anything with legal, financial, medical or safety consequences.

2. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use PickIt on devices you own or control, as allowed by the rules of the Apple App Store or Google Play. You may not copy, modify, reverse engineer, resell or redistribute the app or its content, except where the law allows it.

If you downloaded PickIt from the Apple App Store, Apple's Licensed Application End User License Agreement also applies. If it conflicts with these Terms, the Apple EULA prevails for iOS users.

3. Premium purchase

  • PickIt Premium is a one-time, non-consumable in-app purchase. It is not a subscription and does not renew. It removes ads and unlocks extra features, as described on the purchase screen.
  • The price is shown in the app before you buy. Payment is charged to your Apple ID or Google Play account at confirmation.
  • You can restore Premium on a new device signed in to the same store account by using Restore Purchases in the app.
  • Refunds are handled by Apple or Google under their policies. You can request one at reportaproblem.apple.com or through your Google Play order history. Nothing in these Terms limits your statutory consumer rights.
  • We may add, change or remove features over time. We will not remove the core ad-free benefit of Premium from users who have already bought it while the app is still offered.

4. Ads

The free version of PickIt shows ads provided by Google AdMob. We are not responsible for the content of third-party ads or for the websites and products they link to.

5. Acceptable use and party games

  • Use PickIt lawfully and respectfully. Do not enter offensive, hateful or illegal content as names or list items.
  • Truth or dare prompts are suggestions for entertainment. Every participant decides for themselves whether to do a dare. Skip any prompt that feels unsafe, uncomfortable, or that would break the law or house rules.
  • Never do dares involving alcohol, driving, dangerous stunts, or anyone who has not freely agreed to take part. You are responsible for your own actions and your group's safety.

6. Your content

Names and lists you enter stay on your device and remain yours. When you use the Team Generator, names are sent to a third-party avatar service to create pictures, as explained in our Privacy Policy.

7. Intellectual property

The app, including its design, graphics, sounds, text, prompts and code, belongs to Hangar Apps or its licensors and is protected by intellectual property laws. "PickIt" and its logo are our trademarks. Apple, App Store, Google Play and other third-party names belong to their owners.

8. Disclaimer

PickIt is provided "as is" and "as available". As far as the law allows, we do not make any warranties, express or implied, including that the app will be uninterrupted, error-free or fit for a particular purpose.

9. Limitation of liability

As far as the law allows, Hangar Apps is not liable for any indirect, incidental, special or consequential damages, or for any loss arising from decisions made or actions taken using the app. Our total liability for any claim related to PickIt is limited to the amount you paid for the app in the 12 months before the claim. Some jurisdictions do not allow these limitations, so they may not apply to you.

10. Termination

You can stop using PickIt at any time by deleting it. We may suspend or end your license if you seriously breach these Terms. We may also stop offering the app.

11. Changes

We may update these Terms from time to time. The "Last updated" date shows the current version. If you keep using PickIt after a change, you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the Republic of Türkiye. Mandatory consumer protection laws of your country of residence still apply where they give you more protection.

Kullanım Koşulları

Bu Kullanım Koşulları ("Koşullar"), Hangar Apps ("biz") tarafından yayımlanan PickIt mobil uygulamasının ("PickIt", "uygulama") kullanımı için geçerlidir. PickIt'i indirerek veya kullanarak bu Koşulları kabul etmiş olursunuz. Kabul etmiyorsanız lütfen uygulamayı kullanmayın.

1. Uygulama

PickIt; parmak seçici, çark, yazı tura, zar, takım oluşturucu ve doğruluk mu cesaret mi oyunu gibi araçlar sunan bir parti ve karar verme uygulamasıdır. Sonuçlar rastgeledir ve yalnızca eğlence amaçlıdır. Önemli kararlar, bahisler veya hukuki, mali, tıbbi ya da güvenlik sonuçları olan konular için PickIt'e güvenmeyin.

2. Lisans

Size, PickIt'i sahip olduğunuz veya kontrol ettiğiniz cihazlarda Apple App Store ya da Google Play kurallarının izin verdiği ölçüde kullanmanız için kişisel, münhasır olmayan, devredilemez ve geri alınabilir bir lisans veriyoruz. Yasanın izin verdiği durumlar dışında uygulamayı veya içeriğini kopyalayamaz, değiştiremez, tersine mühendislik yapamaz, satamaz veya dağıtamazsınız.

PickIt'i Apple App Store'dan indirdiyseniz Apple'ın Lisanslı Uygulama Son Kullanıcı Lisans Sözleşmesi de geçerlidir. Bu Koşullarla çelişmesi halinde iOS kullanıcıları için Apple EULA esas alınır.

3. Premium satın alımı

  • PickIt Premium, tek seferlik ve tüketilmeyen bir uygulama içi satın alımdır. Abonelik değildir ve yenilenmez. Satın alma ekranında açıklandığı gibi reklamları kaldırır ve ek özelliklerin kilidini açar.
  • Fiyat, satın almadan önce uygulamada gösterilir. Ödeme, onay anında Apple Kimliğinizden veya Google Play hesabınızdan tahsil edilir.
  • Aynı mağaza hesabıyla giriş yaptığınız yeni bir cihazda uygulamadaki Satın Almaları Geri Yükle seçeneğiyle Premium'u geri yükleyebilirsiniz.
  • İadeler Apple veya Google tarafından kendi politikalarına göre yapılır. İade talebini reportaproblem.apple.com üzerinden veya Google Play sipariş geçmişinizden oluşturabilirsiniz. Bu Koşullar, yasal tüketici haklarınızı hiçbir şekilde sınırlamaz.
  • Zamanla özellik ekleyebilir, değiştirebilir veya kaldırabiliriz. Uygulama yayında olduğu sürece, Premium'u satın almış kullanıcılardan reklamsız kullanım hakkını geri almayız.

4. Reklamlar

PickIt'in ücretsiz sürümü Google AdMob reklamları gösterir. Üçüncü taraf reklamların içeriğinden ve bu reklamların yönlendirdiği web sitelerinden veya ürünlerden sorumlu değiliz.

5. Kabul edilebilir kullanım ve parti oyunları

  • PickIt'i yasalara uygun ve saygılı şekilde kullanın. İsim veya liste öğesi olarak saldırgan, nefret içeren veya yasa dışı içerik girmeyin.
  • Doğruluk mu cesaret mi görevleri eğlence amaçlı önerilerdir. Bir görevi yapıp yapmamaya her katılımcı kendisi karar verir. Güvensiz ya da rahatsız edici gelen, yasaları veya ev kurallarını çiğneyen görevleri atlayın.
  • Alkol, araç kullanma veya tehlikeli hareketler içeren görevleri ya da gönüllü olarak katılmayı kabul etmemiş birini içeren görevleri asla yapmayın. Kendi davranışlarınızdan ve grubunuzun güvenliğinden siz sorumlusunuz.

6. İçeriğiniz

Girdiğiniz isimler ve listeler cihazınızda kalır ve size aittir. Takım Oluşturucu'yu kullandığınızda isimler, Gizlilik Politikası'nda açıklandığı gibi avatar oluşturmak için üçüncü taraf bir hizmete gönderilir.

7. Fikri mülkiyet

Tasarım, grafikler, sesler, metinler, görevler ve kod dahil olmak üzere uygulama Hangar Apps'e veya lisans verenlerine aittir ve fikri mülkiyet yasalarıyla korunur. "PickIt" adı ve logosu bizim markamızdır. Apple, App Store, Google Play ve diğer üçüncü taraf adları kendi sahiplerine aittir.

8. Sorumluluk reddi

PickIt "olduğu gibi" ve "mevcut haliyle" sunulur. Yasanın izin verdiği ölçüde, uygulamanın kesintisiz, hatasız veya belirli bir amaca uygun olacağı dahil olmak üzere açık ya da örtülü hiçbir garanti vermeyiz.

9. Sorumluluğun sınırlandırılması

Yasanın izin verdiği ölçüde Hangar Apps; dolaylı, arızi, özel veya sonuç olarak ortaya çıkan zararlardan ya da uygulama kullanılarak verilen kararlardan veya yapılan eylemlerden doğan kayıplardan sorumlu değildir. PickIt ile ilgili herhangi bir talepte toplam sorumluluğumuz, talepten önceki 12 ay içinde uygulama için ödediğiniz tutarla sınırlıdır. Bazı ülkelerde bu sınırlamalara izin verilmez; bu durumda sizin için geçerli olmayabilir.

10. Sona erme

PickIt'i silerek kullanmayı istediğiniz zaman bırakabilirsiniz. Bu Koşulları ciddi şekilde ihlal etmeniz halinde lisansınızı askıya alabilir veya sona erdirebiliriz. Uygulamayı yayından kaldırma hakkımız da saklıdır.

11. Değişiklikler

Bu Koşulları zaman zaman güncelleyebiliriz. "Son güncelleme" tarihi geçerli sürümü gösterir. Bir değişiklikten sonra PickIt'i kullanmaya devam etmeniz, güncel Koşulları kabul ettiğiniz anlamına gelir.

12. Uygulanacak hukuk

Bu Koşullar Türkiye Cumhuriyeti kanunlarına tabidir. Yaşadığınız ülkenin daha fazla koruma sağlayan zorunlu tüketici koruma hükümleri saklıdır.
